Welcome to www.tools.fengshuitoday.com (“Website”), operated by Feng Shui Today / FST Feng Shui Tools, a service of Shantallow Partners Pty Ltd and Laguna Media (“we”, “us”, or “our”).

By accessing or using this Website and its tools, software, and services (together, the “Platform”), you agree to be bound by these Terms of Use. If you do not agree, you must not use this Website.

1. Use of the Website

This Website provides Feng Shui-related tools, calculators, charts, reports, and client management features for informational and professional support purposes.

You agree to use the Website only for lawful purposes and in a manner that does not:

  • Violate any applicable laws or regulations
  • Infringe the rights of others
  • Interfere with or disrupt the Website or its services
  • Attempt to gain unauthorised access to systems, data, or accounts
  • Use any robot, spider, scraper, script, or other automated means to access, monitor, index, or copy any part of the Platform
  • Record, capture, or reproduce the Platform’s screens, interfaces, or outputs by screen recording, screen capture, video, or photography, other than for your own internal reference
  • Circumvent, disable, or interfere with any security, authentication, watermarking, rate-limiting, or access-control measure

2. Eligibility and Account Approval

The Platform is a professional tool made available to practising Feng Shui consultants. Access is granted by application and approval only. Completing the registration form does not create an account or entitle you to access.

2.1 Eligibility. To be eligible for an account, including a trial account, you must be a practising Feng Shui consultant or a student in active training with a recognised teacher or school.

2.2 Application information. When applying, you must provide accurate and complete information, including:

  • Your full legal name
  • Your practice or business name and the address of your live practice website
  • Your country and city of practice
  • Your training background, including your school or teacher and the year you qualified
  • Your professional association membership and membership number, where applicable
  • The name of a referee, an existing FST subscriber, association member, or your teacher, who can confirm your professional standing
  • A valid payment method, which will be authorised but not charged at the commencement of a free trial

2.3 Approval. All applications are reviewed. We may approve or decline any application at our sole discretion, with or without reason, and are not obliged to provide reasons for a decision. We may contact you, your referee, or any association you nominate to verify the information supplied.

2.4 Representations. By applying for an account you represent and warrant that:

  • All information supplied is true, accurate, and complete
  • You are applying on your own behalf and for your own professional practice
  • You are not, and are not acting for or on behalf of, any person or entity that develops, markets, or intends to develop software, applications, or services that compete or would compete with the Platform
  • You are not applying for the purpose of evaluation, benchmarking, competitive analysis, replication, or the development of a similar or competing product

2.5 False or incomplete information. Supplying false, misleading, or incomplete information in an application is a material breach of these Terms. We may immediately suspend or terminate any account obtained on that basis, without notice and without refund of any fees paid.

2.6 Change in circumstances. If, while holding an account, you become engaged in or associated with the development of a competing product or service, you must notify us in writing and cease using the Platform immediately.

3. Accounts and Access

You agree to:

  • Keep your login credentials secure and confidential
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorised use of your account

Accounts are personal to the approved account holder. You may not share, transfer, sell, sublicense, or provide access to your account, credentials, or session to any other person, including colleagues, staff, students, or clients. Access is limited to one concurrent session per account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

All content, software, tools, designs, source code, interfaces, layouts, workflows, text, graphics, compass artwork, chart assets, calculation implementations, report templates, and materials on this Website are owned by or licensed to us and are protected by intellectual property laws.

You may:

  • Use the tools for your own professional practice
  • Generate reports for your own clients

You may not:

  • Copy, reproduce, distribute, publish, sell, or sublicense any part of the Website, the Platform, or its software
  • Reverse engineer, decompile, disassemble, or attempt to derive or extract the source code, structure, algorithms, or underlying logic of the Platform, whether by inspection, observation, testing, or any other means
  • Study, test, or use the Platform for the purpose of designing, developing, or assisting the development of a competing or substantially similar product, interface, or service
  • Reproduce or imitate the Platform’s interface design, layout, visual presentation, or “look and feel”
  • Extract, harvest, tabulate, or compile the Platform’s data, chart assets, or calculation outputs into any database, lookup table, or reference work
  • Remove, obscure, or alter any watermark, copyright notice, attribution, or identifying mark from any output
  • Reuse or resell outputs as part of a competing product or service

Nothing in these Terms transfers any ownership right in the Platform to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the term of your subscription only.

5. Confidentiality

The non-public elements of the Platform, including its interfaces, workflows, calculation methods and implementations, chart and compass assets, report structures, unreleased features, and any material provided to you on request or under a member-only arrangement, are our confidential information.

You must not disclose, publish, demonstrate, or make that information available to any third party without our prior written consent, and must not use it for any purpose other than your own professional practice. This obligation survives termination of your account.

6. Monitoring, Logging, and Technical Protection

You acknowledge and agree that:

  • We log account activity, including access times, IP addresses, device and browser information, and feature usage, for security, licensing, and abuse-detection purposes
  • We may apply visible and non-visible watermarking to reports and outputs generated by your account, identifying the account and the date of generation
  • We may apply rate limits and monitor for abnormal usage patterns consistent with systematic data extraction
  • We may suspend access immediately, pending investigation, where activity is consistent with scraping, credential sharing, or attempted extraction

7. Fees, Trials, and Payments

Some features require payment or subscription.

By purchasing or subscribing, you agree that:

  • Fees are clearly presented before purchase
  • Payments are processed via third-party providers
  • All fees are non-refundable unless stated otherwise or required by law

Free trial. A free trial requires an approved account and a valid authorised payment method. Unless cancelled before the trial ends, the trial converts to a paid annual subscription at the rate presented at signup. Trials are limited to one per person and per practice.

We reserve the right to change pricing at any time.

8. User Content

You may upload or input data, including client details, floor plans, and notes.

You retain ownership of your content, but you grant us a limited licence to:

  • Store, process, and display the data for service functionality
  • Improve and maintain the platform

You are responsible for ensuring you have the right to use and upload any data, including compliance with privacy laws.

9. Privacy

Your use of the Website is also governed by our Privacy Policy.

You are responsible for complying with applicable privacy and data protection laws when using client information within the platform.

10. Disclaimer of Warranties

The Website and its tools are provided “as is” and “as available.”

To the extent permitted by law, we make no warranties, express or implied, including as to:

  • Accuracy or reliability of calculations or outputs
  • Suitability for any specific purpose
  • Continuous availability or error-free operation

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any:

  • Direct, indirect, incidental, or consequential damages
  • Loss of data, income, business, or reputation
  • Decisions made based on use of the Website or its outputs

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law. Where our liability cannot be excluded, it is limited, at our option, to resupplying the service or paying the cost of having the service resupplied.

12. Remedies and Indemnity

You acknowledge that a breach of clause 4 (Intellectual Property) or clause 5 (Confidentiality) may cause harm for which monetary damages are an inadequate remedy, and that we are entitled to seek injunctive or other equitable relief in addition to any other remedy available.

You indemnify us against any loss, cost, or claim arising from your breach of these Terms, your misuse of the Platform, or your use of client data within it.

13. Termination

We may suspend or terminate your access at any time if:

  • You breach these Terms
  • You misuse the Website
  • Your account was obtained through false or incomplete application information
  • You are found to be developing, or acting for a person developing, a competing product or service
  • We discontinue the service
  • The 7-day trial period expires without payment

Termination for breach is without refund of any fees paid. Clauses 4, 5, 11, 12, and 14 survive termination.

You may stop using the Website at any time.

14. Acceptance and Record

Registration, or continued use of the Platform, constitutes acceptance of these Terms. Your acceptance is recorded electronically, together with the date, time, IP address, and account identifier, and constitutes your electronic signature for the purposes of the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions (Queensland) Act 2001.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Website after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of the courts of that State, unless otherwise required by applicable law.
